Doctor charged with fraud faces federal judge

LAUDERDALE COUNTY, AL (WAFF)- A doctor facing charges appeared before a federal judge Wednesday afternoon for an arraignment hearing.

Dr. Diana McCutcheon is charged with fraud.

She appeared in federal court with her attorney, Robert Tuten.

McCutcheon pleaded not guilty to the 96-count indictment filed in U.S. District Court.

She's accused of billing Blue Cross Blue Shield and Medicare for non-reimbursable cosmetic skin treatments totaling $1.3-million.

 "Dr. McCutcheon is convinced this is a paperwork mix up. It is easy to mix up numbers and transpose a number on a code. It could practically invalidate the entire bill. She believes that is what's happened here. She is certainly willing to repay any money she was wrongfully paid and she does not deserve," said Tuten.

McCutcheon was ordered to turn over her passport and she was given a $25,000 unsecured bond that she will have to pay if she fails to appear in court.

Schools meet with state superintendent to discuss uniform calendars

Florence and Lauderdale County schools plan to seek guidance from state superintendent, Dr. Tommy Bice, then vote on the calendar for the upcoming school year.

Florence City Schools say the calendar committee will meet Thursday afternoon after hearing from Dr. Bice.

Employees will be allowed to vote on the plan they prefer on Friday.

Florence superintendent anticipates a board meeting to be called on Tuesday to vote on the new calendar.

Lauderdale County Schools reworked the calendar to go before the board for a vote on Thursday evening.

The school boards decided not to make a decision about next year's calendar before getting guidance from the State Board of Education.

4 men charged for stealing artifacts from TVA

LAUDERDALE COUNTY, AL (WAFF)- Four men were fined in federal court for stealing cultural artifacts from TVA property.

Roger Fountain and Heath Dubois of Tuscumbia and John Bates of Florence pleaded guilty to theft of government property. The charge was in violation of the Archaeological Resource Protection Act. The artifacts were stolen from the Pickwick Reservoir shoreline.

Matthew Buttrman of Ider pleaded guilty to theft of government property. He was accused of stealing Native American relics from the Guntersville Reservoir.

Each defendant was sentenced to one year probation and $500 in fines.

An official with TVA said that ARPA violations are aggressively pursued in an effort to preserve cultural and local history.

If any of the man violate ARPA again, they could face five years in prison and a $250,000 fine.

Florence City Council votes to rezone land

FLORENCE, AL (WAFF)- The Florence City Council voted to rezone land in Florence for during a meeting Tuesday evening.

The area is near the intersection of Cloverdale Road and Cox Creek. The land will eventually pave the way for a new Walmart.

Since January, the "CAUS" group has been very vocal on their stance against rezoning.

Dozens of people attended the meeting to discuss their opinions on rezoning. The crowd overflowed into the streets and police were on hand to deal with crowd control.

The meeting took nearly four hours. The council heard from both sides on the issue.

One resident in favor of the decision said Walmart will bring jobs for minorities that the mom and pop stores can't.

Another resident against the decision said she doesn't want the noise and traffic of Walmart so close to her home.

Elderly man struck by truck and killed

FLORENCE, AL (WAFF)- An elderly man was killed by a passing truck in Lauderdale County Tuesday morning.

The vehicle struck him on Alabama 157. Troopers said that Ozie Tucker, 91 was killed at around 3:40 a.m.

His body was found in the roadway and pronounced dead on the scene.

The driver was Ronald Liles of Florence. He was uninjured.

Authorities said Tucker was wearing dark clothing and it was foggy which could have lead to the accident.

The case is under investigation.
